By accessing or using the Cinemenu platform, you agree to be bound by these Terms. If you are using the service on behalf of a restaurant or business entity, you represent that you have the authority to bind that entity to these terms.

2. Service Description

Cinemenu provides a web-based platform for digital menu management and order processing. You acknowledge that Cinemenu is a technology provider and is not a party to the actual transaction between the Restaurant and the End-Consumer.

3. User Accounts & Responsibilities

• Account Security: You are responsible for maintaining the confidentiality of your login credentials.
• Authorized Use: You agree to use the service only for lawful purposes. You may not reverse engineer, decompile, or attempt to extract the source code of the platform.

4. Payments and Fees

• Subscription Fees: You agree to pay all fees associated with your selected plan.
• Payment Processing: We may use third-party payment processors (e.g., Stripe). You agree to their terms and acknowledge that Cinemenu is not responsible for processing errors caused by these third parties.
• Taxes: You are responsible for all sales, use, or excise taxes related to your business transactions.

5. Intellectual Property

• Our IP: Cinemenu retains all rights, title, and interest in the software, logos, and design.
• Your Content: You retain ownership of your menu data, photos, and branding. By uploading content, you grant Cinemenu a non-exclusive license to host and display that content on the platform to fulfill the service.

6. Disclaimer of Liability

• No Responsibility for Fulfillment: Cinemenu is not responsible for the quality, safety, accuracy, or delivery of the food or drinks ordered. Any disputes regarding food quality, allergies, or order accuracy must be resolved directly between the Restaurant and the Customer.
• No Warranty: The service is provided "as is" and "as available." We do not guarantee that the service will be error-free or uninterrupted.

7. Limitation of Liability

To the maximum extent permitted by law, Cinemenu shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business interruption, arising from your use of the service. Our total liability shall not exceed the amount you paid to us in the six (6) months preceding the claim.

8. Data Privacy

Your use of Cinemenu is also governed by our Privacy Policy. You represent that you have all necessary rights and permissions to collect and process customer data through our platform in compliance with applicable privacy laws (e.g., GDPR/CCPA).
